Tract I:

Legal Description:  Legal description will be provided upon completion of a legal survey if property sells in separate tracts. Surface rights only.

Minerals:  Seller reserves the minerals in and under said described real estate for a period of 20 years and as long as oil and gas may be produced therefrom.

General Description:   This tract of land has approximately 96.99 acres of cultivation.  FSA information: It carries a 42.5 acre wheat base w/31 bu yield and 39.3-acre sorghum base w/48 bu yield.

Possession: Possession to purchaser will be Dec. 31, 2019 with purchaser receiving 1/3 share of harvested crops.

Tract II:

Minerals: Seller reserves the minerals in and under said described real estate for a period of 20 years and as long as oil and gas may be produced therefrom.

General Description:  Tract III will be a combination of Tract I and Tract II added together plus a $5,000.00 advanced bid.

Possession: Purchaser will receive possession of 53.40 acres of grassland and farmstead upon closing and will receive possession of 96.99 acres of cultivation on Dec. 31, 2019 and will be receiving 1/3 share of crops harvested.

 

Tract IV: 

Legal Description:  East Half (E/2) of the Southwest Quarter (SW/4) of Section Nineteen (19), Township Fourteen (14), Range Seventeen (17) West of the 6th P.M. in Ellis County, Kansas

Minerals:  Sellers shall convey 100% of the seller’s minerals to the purchaser.

General Description:  This tract of land has approximately 7.40 acres of cultivation and 69.02 acres of pasture grassland.  FSA information: It carries a 5.5 acre wheat base w/32 bu yield.  This tract of land has well established grass, Big Creek is running through property, has a 5” cased water well with a solar pump, has a 12.5’ tire tank and good pasture fence.  The water well will support a home.  This tract is an excellent habitat for wildlife.

Possession:  Purchaser will receive possession upon closing on grassland and will receive possession on 7.40 acres on Dec. 31, 2019 and will be receiving 1/3 share of harvested crops.

 

Terms, Taxes, & Title Insurance: Ten percent (10%) down day of sale, balance due upon closing. This auction sale is not contingent upon the purchaser’s ability to finance the purchase. Buyers must make finance arrangements, if needed, prior to the auction. Seller shall pay all the 2018 taxes and prior year taxes. 2019 taxes shall be prorated to date of closing and subsequent years taxes shall be the responsibility of the Buyer. 2018 taxes were Tract III $2,769.86 and Tract IV $161.72. Title insurance shall be used to prove clear and merchantable title with the Buyer & Seller sharing equally the owner’s policy expense. The mortgagee’s policy, if required, will be the expense of the buyer.
